SantaSpotted — Terms of Use

1. Acceptance of Terms

By downloading, accessing, or using SantaSpotted (the "App"), you agree to be bound by these Terms of Use and all applicable laws. If you do not agree, please do not use the App.

These Terms apply to all users of the App.

2. Overview of the Service

SantaSpotted allows users to capture a photo of their living room and generate a personalized, AI-produced video featuring Santa Claus in that environment.

Some features are available for free, while others require consumable in-app purchases ("Credits"). Features may change over time as the App evolves.

SantaSpotted is intended for entertainment purposes only.

3. In-App Purchases (Consumable Credits)

• SantaSpotted uses consumable in-app purchases sold as Credits.
• Credits are used to generate AI videos.
• Payment is charged to your Apple ID account at the time of purchase.
• Credits do not auto-renew and are non-refundable, except where required by law.
• Refunds for purchases made through the App Store are handled entirely by Apple.
• Prices may vary by region due to taxes or currency differences.
• Future pricing or Credit requirements may change, but such changes do not affect Credits already purchased.

If a video generation fails due to a technical issue on our side, we may, at our discretion, restore consumed Credits.

4. Data Use and Privacy

To generate Santa videos, SantaSpotted temporarily processes the photo you upload and the resulting video.

We do not store, save, or retain any photos, videos, or personal data. Processing occurs only for the purpose of generating your requested content, after which the data is discarded.

We do not collect analytics on your images, share your data, or upload it to any external system beyond the temporary processing required to create your video.

5. Sharing and Use of Generated Videos

SantaSpotted allows you to save, download, and share the videos you generate. You may share these videos for personal, non-commercial purposes, including posting on social media.

The videos generated by SantaSpotted are fictional and for entertainment only. You are solely responsible for how you choose to use or share them. Fitmarket Life d.o.o. does not access, store, or monitor user videos and is not liable for any consequences related to sharing or distributing your generated content.

You agree not to share any generated video in an unlawful, harmful, or misleading manner, including presenting it as real surveillance footage or using it to deceive, harass, or harm others.

By sharing your videos publicly, you acknowledge you do so at your own risk.

6. User Responsibilities

You agree to use the App only for lawful, appropriate, and non-harmful purposes. You may not:

• Upload content that is illegal, abusive, or that violates others' rights;
• Attempt to reverse engineer, disrupt, or misuse the App;
• Use the App to generate content intended to deceive or harm others;
• Upload photos that you do not have the rights or permission to use.

You are responsible for ensuring you have the necessary rights to any photo you upload.

7. No Medical, Safety, or Professional Advice

SantaSpotted is for fun and entertainment only. The video output is fictional and should not be interpreted as real footage or evidence of any real events.

8. Intellectual Property

All rights in the App, including its software, branding, and features, belong to Fitmarket Life d.o.o. You may not modify, distribute, or reproduce any part of the App without written permission.

The videos generated for you may be used for personal purposes, including sharing, unless otherwise restricted by these Terms.

9. Limitation of Liability

SantaSpotted is provided "as is," without warranties of any kind. To the maximum extent permitted by law, Fitmarket Life d.o.o. is not liable for any indirect, incidental, consequential, or special damages arising from:

• Use of or inability to use the App;
• Sharing or misuse of generated videos;
• Loss of data;
• Device issues or interruptions.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Apple as a Third-Party Beneficiary

Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce them against you.

11. Governing Law

These Terms are governed by the laws of the Republic of Croatia, excluding its conflict-of-law rules. Any disputes shall be resolved exclusively in Croatian courts.

12. Modifications to the Terms

We may update these Terms occasionally. Continued use of the App after updates constitutes acceptance of the revised Terms. The latest version will always be available within the App or at a provided URL.

13. Apple EULA

By using SantaSpotted, you also agree to Apple's Licensed Application End User License Agreement (EULA). These Terms supplement, not replace, Apple's EULA.
